Technical acceptability of witness and participant testimonies at traffic accident

This master’s thesis deals with issues of road traffic accidents from the perspective tes-timonies of witnesses of road traffic accidents, especially in terms of the space and time per-ception and in terms of the content development changes during time. This issues are solved at first theoretically, gained knowledge is then used by several real accidents. For each traffic accident was selected several questions important to solve its course and in the testimonies of witnesses and participants have found the answers to these questions. In the responses were monitored technical acceptability and content development of the testimonies during time, and then were made ratings of the technical acceptability of the each answer and score rating of compliance with the previous testimony. This allowed determining for each witnesses or participant and for every traffic accident level of technical unacceptability responses and the level of testimonies content development changes during time.

in English, Title and Keywords The Specifics of Children Interrogation Children, meaning people under 18 years of age, appear in criminal procedures rather often and have various process statuses. Therefore, they can get into a situation in which they have to be interrogated. In these cases, they need a different approach than adults. Moreover, they also deserve an extra level of protection. Legislation has taken this into account by specifying how children should be treated during criminal procedures, interrogation included, in numerous details. Amongst these legal provisions, one can find for example the legal provision about necessary protection of minors, about the presence of certain other people during interrogation or the provision regulating the possibility of interrogating children before the prosecution officially begins. Both the Constitutional Court of the Czech Republic and also the European Court of Human Rights have commented on the possibilities of interrogating children before the prosecution start and then using such obtained protocols, especially on the aspect of preserving the rights of defense. Facing the loss: Loss figures in the postwar central european literature

My paper will focus upon the theme of loss in postwar Central European literature in works of Nabokov, Bachmann, Bernhard, Handke, Esterhazy, and Chwin, which are narrated as a modern subject's testimony of loss. My goal is to make a collection of loss figures (inspired by Roland Barthes's Fragments of a Lover's Discourse) to examine the nature of testimony in relation to the acts of writing. Any analytical inquiry that focuses itself on the literary testimony as a work of art will have to deal with these textual mechanisms: transparency, suppression, deleting, distancing, turning over, heaviness and reduction.

Ve své práci ukazuji na svědeckých záznamech přístupných v Malach jakými způsoby je utvářeno svědectví. To ve své práci vnímám jako specifický žánr, který je ovlivňován zároveň diskursem a pravidly vyprávění. Ve své práci se pokouším ukázat způsoby, tomu dochází, a tím přispět k lepšímu pochopení svědectví jako takového. Důvodem této snahy je pak mimo jiné i vzrůstající míra využívání svědectví k vzdělávacím účelům, ve kterých se původně doplňkové funkce ve vzta historiografii dostává svědectví stále více prostoru i jako vlastnímu zdroji informací. Skrze výpovědi pamětníků je svědectví schopné přenášet nejen prosté informace, ale díky své autenticitě také emoce a morální apel. Ve své práci na materiálech USC Shoah Foundation Institute ukazuji způsoby, kterými dochází jak k omezování vyprávění diskursem, tak příklady, ve kterých nachází vyprávění v diskursu oporu, či taková, ve kterých se projevuje moc vyprávění nad diskursem. K tomuto závěru docházím na základě analyzování oficiálních dokumentů nadace USC Shoah Foundation Institute. Mezi ně patří podklady pro tazatele a pamětníky, které mají zmiňovaní k dispozici dříve, než je videozáznam pořizován. The credibility of testimony in criminal proceedings

66 The credibility of testimony in criminal proceedings Abstract This thesis focuses on assessing the credibility of testimony in criminal proceedings with a closer focus on assessing the credibility of testimony by investigative, prosecuting and adjudicating bodies. For this purpose, in the first part of the thesis, the author defines the term "testimony", describes its role in the criminal proceeding and distinguishes its role in the criminal proceeding as opposed to that in the civil proceeding. Then, the author defines the term "interrogation" and identifies institutes of criminal law applied in the course of criminal proceedings, by which the testimony is obtained. In the following, third chapter, the author focuses on the explanation of the concept of credibility of testimony, and differentiates its various types. In the fourth and fifth chapter, the author identifies, describes and evaluates possible ways of assesing the credibility of testimony by investigative, prosecuting and adjudicating bodies in context of current case law. Special attention is paid to expertises, their assignment, interpretation and evaluation. Bataille's L'expérience intérieure as an Event of Extremity of Human Existence

The presented study takes up the problem of Bataille's impossible testimony of the impossible. This endeavor represents a wider contextual framework for a project of this thesis which proposes a way of laying down the foundation for a philosophical reading of Bataille's L'expérience intérieure by developing some key moments of his anthropology. Bataille's thought is introduced as the dynamics of a gesture of testimony (or a witnessing) which testifies to the difference du sens as it is being incorporated in the movement of writing (écriture) into the texts of La Somme Athéologique. Since these texts oftentimes resist a direct philosophical treatment, this essay discusses the possibilities of a philosophical approach to Bataille. Such discussion results in setting up the necessary limitations of an adequate philosophical attitude towards Bataille's thought while leaving its problematic quality in play. Then the narrower framework of this essay is put into work in an attempt to achieve an understanding of key parts of The Inner Experience through a philosophical analysis of Bataille's concept of humanity.
Construction and Testimony: Dual Approach to Photography in Work of Didi-Huberman

5 Abstract This thesis deals with topic concerning photography and its relation to reality in work of French philosopher and art historian Georges Didi-Huberman. The thesis is divided into two main chapters. The first main part includes introduction to Didi- Huberman's approach and familiarization with his terms as well as theoretical analysis of photography through his work. This part also includes comparison with approach of the other authors, for example with Roland Barthes. The goal of this thesis is to identify possible ways thinking about photography, from the perspective of photography as a construct and photography as a testimony. The goal of the second main part is to use Didi-Huberman's approach and apply it on several selected photographies within contemporary context. Psychological Aspects of Interrogation

The diploma thesis deals with psychological aspects of interrogation. The aim of the thesis is to describe general psychological aspects of interrogation, contained in scientific publications in comparison to practical knowledge, gathered by experienced police detectives. The thesis covers both psychological aspects of interrogated person as well as the interrogator. The thesis is comprised of four parts, each divided into chapters and subchapters. In the first part, the focus of the thesis is on testimony, its creation and above all verifying its credibility, as the primary aim of an interrogation is to achieve a complete and credible testimony. In the thesis, there are mentioned psychological methods how to achieve such a testimony, and at the same time how to avoid psychological errors of the investigator. The core of the thesis is dedicated to the topic of psychology of interrogation. This part is divided into three chapters; first chapter describes perception level of both interrogator and interrogated, the second covers the mutual interaction of both parties, and the third one their mutual communication.
